India tribunal declines Google’s request to block Android antitrust ruling

An Indian tribunal on Wednesday declined a request by Google to block an antitrust ruling that ordered the tech giant to change its approach to its Android platform, dealing the U.S. firm a setback in a key growth market. In October, the Competition Commission of India (CCI) fined Alphabet Inc’s Google $161 million for exploiting its dominant position in markets such as online search and the Android app store, and asked it to change curbs on smartphone makers related to pre-installing apps.During the hearing, Google’s counsel, Abhishek Manu Singhvi, repeatedly pushed for putting the decision on hold, or extending the date of implementation of CCI’s directives beyond Jan. 19. He said the CCI’s decision will force the company to change its business model and harm consumer interest. The tribunal did not agree. “We are of opinion that at the moment given the voluminous nature of the appeal, there is no need to pass any interim order,” the two-member tribunal panel said.Google told the tribunal in a legal filing that CCI’s investigation unit copied parts of a European ruling against the U.S. firm from a similar verdict on abuse of market dominance of its Android operating system, Reuters reported on Tuesday. The CCI investigators “copy-pasted extensively from a European Commission decision, deploying evidence from Europe that was not examined in India”, Google alleged. The CCI has not responded yet to those allegations.

Google vs CCI

  • The CCI order passed in October 2022, apart from imposing a penalty had asked the tech giant to cease and desist from unfair business practices.
  • The competition watchdog also asked Google to modify its conduct within a defined timeline. The order mandated Google not to force Original Equipment Manufacturers (OEMs) of smart devices to pre-install its own apps or restrict users from un-installing such apps.
  • Further, the US-based company was asked not to offer any incentives to OEMs in order to ensure the exclusivity of its search services.

The National Company Law Appellate Tribunal on Wednesday directed Google to pay 10 per cent of the Rs 1,337.76-crore penalty imposed on the tech giant by fair trade regulator CCI. A two-member bench, however, declined to grant any immediate stay the operations of Competition Commission of India (CCI) penalty and said it would pass any order after hearing out other parties. The appellate tribunal has issued notices to CCI and directed to list the matter on February 13, for hearing over interim stay. The NCLAT direction came over a petition filed by Google, challenging the CCI order on the tech giant abusing its dominant position in multiple markets in the Android mobile device ecosystem, saying the verdict is a setback for Indian users and will make such devices more expensive in the country. On October 20 last year, CCI slapped a penalty of Rs 1,337.76 crore on Google for anti-competitive practices in relation to Android mobile devices. In the October ruling, CCI had also ordered the internet major to cease and desist from various unfair business practices. This was challenged by Google before NCLAT, which is an appellate authority over the CCI against any direction issued or decision made or order passed by the regulator. In its petition, Google had sought an interim stay over the penalty.Android has greatly benefitted Indian users, developers, and Original Equipment Manufacturers (OEMs) and powered India’s digital transformation, Google had said.It also alleged that the Director General (DG) has copy-pasted paragraphs from the rulings of foreign authorities.

Indian Economy News LIVE Updates: Growth of Indian private sector output climbs to near 11-year high

India’s services industry saw activity increase at the fastest pace in six months during the final month of 2022 amid robust demand, fuelling business optimism despite high costs, a private-sector survey showed. The S&P Global India services purchasing managers’ index (PMI) rose to 58.5 in December from 56.4 in the previous month, confounding expectation in a Reuters poll for a fall to 55.5.The index was above the 50-mark separating growth from contraction for the 17th straight month – the longest stretch of growth since June 2013.”As we head into 2023, companies signalled strong optimism towards the outlook for output,” noted Pollyanna De Lima, economics associate director at S&P Global Market Intelligence.”Inflation trends were mixed, as input prices rose at a faster pace and the upturn in charges moderated.”Expenses rose faster due to greater energy, food, staff and transportation costs so prices charged remained elevated despite moderating slightly from November, when they rose at the quickest rate since July 2017.This could elevate India’s retail inflation which eased to 5.88% in November, below the top of the Reserve Bank of India’s target band of 4%-6% for the first time in 2022.
